Apostate in Islam
Apostasy in Islam (Arabic: ردة riddah or ارتداد irtidād) is commonly defined as the conscious abandonment of Islam by a Muslim in word or through deed. It includes the act of converting to another religion or non-acceptance of faith to be irreligious, by a person who was born in a Muslim family or who had previously accepted Islam.
Why does Islam not allow apostasy? Apostasy in Islam is equal to treason? Is it treason to Allah? Then isn’t it allah who should decide at the day of judgment how these people should be judged of it?
The vast majority of Sunni and Shia jurists states that for an adult, apostasy from Islam is not only a sin but also an act of treason punishable with the death penalty. Typically after a waiting period to allow the apostate time to repent and to return to Islam.
Laws of countries and apostate
As of 2020, there are 12 countries that have the death sentence for apostasy which includes Afghanistan, Iran, Malaysia, Maldives, Mauritania, Nigeria, Pakistan, Qatar, Saudi Arabia, Somalia, Sudan, United Arab Emirates and Yemen are the relevant countries. All of these countries, except Pakistan, allow for capital punishment against apostasy, while Pakistan imposes the death penalty for blasphemy - including a disbelief in God of Islam and Prophet Muhammad, which makes anyone rejecting Muhammad to be a prophet puts that person under the blasphemy law as the law does not define blasphemy. Under Article 295-C of its penal code, any Pakistani Muslim who feels his or her religious feelings have been hurt, directly or indirectly, for any reason or any action of another Pakistani citizen can accuse blasphemy and open a criminal case against anyone. Inheritance and property rights for apostates was also prohibited by Pakistan in 1963.

Some countries included do not have actual anti-apostasy laws, but their laws on blasphemy against Muhammad can also be utilized to try people for apostasy. These countries include Algeria, Bahrain, Egypt, Indonesia, Iran, Iraq, Jordan, Kuwait, Lebanon, Libya, Mauritania, Morocco, Oman, Pakistan, Syria, and Tunisia.
There is evidence that extrajudicial prosecution of those who are accused of being apostates is carried out throughout the Muslim world.
The following countries have criminal statutes that forbid apostasy or blasphemy:
- Afghanistan – Apostasy illegal by Law
- Brunei - per recently enacted Sharia law, Section 112(1) of the Brunei Penal Code states that a Muslim who declares himself non-Muslim commits a crime that is punishable with death, or with up to 30 year imprisonment, depending on the type of evidence. However, if the accused has recanted his conversion, he may be acquitted of the crime of apostasy.
- Comoros -Apostasy illegal by law (death penalty)
- Iran -not in the Penal Code, but the use of the death penalty for cases of apostasy was approved by the Iranian Parliament in 2008.
- Jordan -possibly illegal (fine, child custody loss, marriage annulment) although officials claim otherwise, convictions are recorded for apostasy
- Kuwait -Apostasy is not illegal in Kuwait, although apostasy is penalized in family courts for Muslims. For Muslims, apostasy in family court can result in loss of child custody, inheritance rights, annulment if married to a Muslim.
- Malaysia -illegal in five of thirteen states (fines) if they do not get conversion permission from Sharia court. Additionally, a number of states have voted bills into law that allow for apostates from Islam to be detained and reeducated.
- Maldives - illegal for Muslim nationals (loss of citizenship). Illegal to proselytize for religions other than Islam.
- Mauritania -illegal (death penalty if still apostate after 3 days)
- Morocco -not illegal, but official Islamic council decreed apostates should be put to death. Illegal to proselytize for religions other than Islam (six months to three years imprisonment)
- Oman -illegal (prison) according to Article 209 of Oman penal code, and denies child custody rights under Article 32 of Personal Status Law
- Qatar -illegal (death penalty)
- Saudi Arabia -illegal (flogging, imprisonment and death penalty, although there have been no recently reported executions)
- Somalia -illegal (death penalty)
- Sudan -illegal (death penalty)
- Syria -defamation of religious proceedings punishable with 2 year jail sentence.
- United Arab Emirates -illegal (3 years' imprisonment, death penalty)
- Yemen -illegal (death penalty)
Islamic Sects and Apostasy
- Hanafi – recommends three days of imprisonment before execution, although the delay before killing the Muslim apostate is not mandatory. Apostates who are men must be killed, states the Hanafi Sunni fiqh, while women must be held in solitary confinement and beaten every three days till they recant and return to Islam. Penalty for Apostasy limited for those who cause Hirabah after leaving Islam, not for personal religion change.
- Maliki – allows up to ten days for recantation, after which the apostate must be killed. Both men and women apostates deserve death penalty according to the traditional view of Sunni Maliki fiqh.
- Shafi'i – waiting period of three days is required to allow the Muslim apostate to repent and return to Islam. After the wait, execution is the traditional recommended punishment for both men and women apostates.
- Hanbali – waiting period not necessary, but may be granted. Execution is traditional recommended punishment for both genders of Muslim apostates.
- Ja'fari – waiting period not necessary, but may be granted according to this Shia fiqh. Male apostates must be executed, states the Jafari fiqh, while a female apostate must be held in solitary confinement till she repents and returns to Islam.

Whoever disbelieves in Allah after his belief... except for one who is forced [to renounce his religion] while his heart is secure in faith. But those who [willingly] open their breasts to disbelief, upon them is wrath from Allah, and for them is a great punishment; (Quran 16:106)
Indeed, those who reject the message after their belief and then increase in disbelief - never will their [claimed] repentance be accepted, and they are the ones astray.(Quran 3:90)
The allah’s punishment on apostate and then what is asked of muslims to do with Apostate as follow
They wish you would disbelieve as they disbelieved so you would be alike. So do not take from among them allies until they emigrate for the cause of Allah . But if they turn away, then seize them and kill them wherever you find them and take not from among them any ally or helper. (Quran 4:89)
You will find others who wish to obtain security from you and [to] obtain security from their people. Every time they are returned to [the influence of] disbelief, they fall back into it. So if they do not withdraw from you or offer you peace or restrain their hands, then seize them and kill them wherever you overtake them. And those - We have made for you against them a clear authorization. (Quran4:91)
Hadith are actually more clear in this subject matter:

as you can see in the above hadith has many references all of which are sahih i.e. authantic

Ali burnt some people and this news reached Ibn 'Abbas, who said, "Had I been in his place I would not have burnt them, as the Prophet said, 'Don't punish (anybody) with Allah's Punishment.' A man embraced Islam and then reverted back to Judaism. Mu'adh bin Jabal came and saw the man with Abu Musa. Mu'adh asked, "What is wrong with this (man)?" Abu Musa replied, "He embraced Islam and then reverted back to Judaism." Mu'adh said, "I will not sit down unless you kill him (as it is) the verdict of Allah and His Apostle." —Sahih al-Bukhari, 9:89:271
... Mu'adh asked, "Who is this (man)?" Abu Muisa said, "He was a Jew and became a Muslim and then reverted back to Judaism." Then Abu Muisa requested Mu'adh to sit down but Mu'adh said, "I will not sit down till he has been killed. This is the judgment of Allah and His Apostle (for such cases) and repeated it thrice. Then Abu Musa ordered that the man be killed, and he was killed. Abu Musa added, "Then we discussed the night prayers and one of us said, 'I pray and sleep, and I hope that Allah will reward me for my sleep as well as for my prayers.'" (Sahih al-Bukhari, 9:84:58)

Conclusion
As of 2014, twenty-five countries criminalize public apostasy. As of 2014, no country in the North and South Americas or Europe had any law forbidding the renunciation of religious.
